• Trademark Food Fight: Did In-N-Out Burger Abandon the Triple Triple?

Smashburger asserts that In-N-Out stopped using the Triple Triple mark and thus, abandoned its rights, when the triple meat, triple cheese hamburger was rebranded as the 3X3 hamburger over three years ago, the generally understood benchmark for abandonment of rights. And, in my research of In-N-Out’s archived web pages, as far back as 2012, In-N-Out appears to have done exactly what Smashburger asserts – it replaced the Triple Triple hamburger from its Not-So-Secret Menu with the 3X3…

  • Protecting Your Intellectual Property in the Internet of Things

The Internet of Things (IoT) has been upon us for some time now, though many are just beginning to see it — the interconnected network of devices that increasingly surrounds us. We actually welcomed the first personal IoT device a while ago in the smart phone, a device whose functionality depends on its connection to a cellular network or the internet. Imagine the impact your phone has had many times over — with billions of interconnected smart devices — and you get a sense of the IoT’s…

  • Dr. Carolyn Bertozzi pioneers bioorthogonal chemistry to study molecules within living systems

Most fields of chemical science designed to look at biological process involving living molecules suffer from a rather serious drawback— studying those molecules within a living body without interfering with any other processes. Over the past two decades, however, an entirely new scientific field has opened up which enables the study of chemical reactions occurring within living systems with no interference to any biochemical processes native to that living system. Bioorthogonal chemistry was…

  • Cheek Responds: The Whole Story

I previously wrote about Alfred Pirri’s federal complaint against Lori Cheek and her company Cheek’d.  The story looked like an odd-ball law professor exam question:  Mild mannered Pirri had a great idea for reverse online dating, he told his personal therapist who told a friend (who happened to be the fabulous entrepreneur Lori Cheek) and the friend […]

    MINIATURIZE / MINIATURISE 小型化する

    –>小形化

$$ The generation of suitable vacuum conditions to provide mass spectrometer operation remains a major miniaturisation obstacle. / 質量分析器の動作を提供するために適した真空条件を生成することは、依然として小型化の大きな問題である。(USP7619265)

$$ Such pumps are well known, but it has proven difficult to miniaturize them to the level desired by many patients using ambulatory pumps. / 上記のようなポンプは良く知られているが、斯かるポンプを歩行用ポンプを使用する多くの患者により望まれるようなレベルまで小型化することは困難であることが分かっている。(USP7284962)

$$ The authors describe a method for fabricating atomic vapour cells for application in highly miniaturised atomic clocks and magnetometers. / 著者らは、高度に小型化された原子時計および磁力計に応用するための原子蒸気セルの製造方法を記載している。(USP8079763)

$$ The problem may be further exacerbated by the current drive towards miniaturisation. (USP6965789)

$$ More than one operating mechanism 2 with a corresponding outlet at 40 may be provided in one shower head e.g. by means of a suitable miniaturized form of each mechanism within the head. (USP6648245)

$$ In a preferred embodiment of the present invention, the activation device is a highly miniaturized resistive probe as described below. (USP6405137)

  • Industry Reaction to the Federal Circuit’s Decision in Aqua Products v. Matal

First-take reaction to Aqua Products v. Matal from a distinguished panel of experts. Todd Dickinson: “I don’t think that I’ve ever seen such a collection of procedural somersaults and arcane discussion masquerading as an appellate opinion. ” Russell Slifer: “it would be wise for the USPTO and the PTAB to consider limiting all Board decisions wholly to the record developed during the proceeding. Eliminate the opportunity for a panel to issue a sua sponte reason for unpatentability.” Ashley…
