このクレームに記載されている"circuit"について、米国知財高裁は、"circuit"は構造物であり、35 U.S.C.§112¶6（§112(f)）は適用されないと判断しています。
米国知財高裁は、§112¶6が適用されるための原則として、クレームに"means"という表現が含まれている必要があり（CCS Fitness, Inc. v. Brunswick Corp., 288 F.3d 1359, 1369 (Fed. Cir. 2002)）、この原則を覆すためには（"means"がなくても§112¶6を適用させるためには）、明確な構造物が開示されていないことを証明する必要があるところ（Watts v. XL Sys., Inc., 232 F.3d 877, 880 (Fed. Cir. 2000)）、今回このような証明はなされていないと米国知財高裁は述べています。

Graf, Modern Dictionary of Electronics 116 (7th ed. 1999) (defining "circuit" as "[t]he interconnection of a number of devices in one or more closed paths to perform a desired electrical or electronic function").
以上の理由から、"circuit"は構造物であるため§112(f)が適用されないと結論付けられています。このLinear Technologyをもとに、"circuit"＝構造物＝「Not §112(f)」が一般的な認識になっています。そして、「Not §112(f)」を目的として、前述のように「～部」に対して"circuit"が使われることがあります。
